Services Provided

HostFire provides website hosting, domain registration, email hosting, and related support services. We aim to provide reliable and secure hosting, but we cannot guarantee that Services will be uninterrupted or error-free.

Eligibility

By using our Services, you confirm that:

  • You are at least 18 years of age, or have parental/guardian consent.
  • You are legally capable of entering into binding contracts.
  • You are using our Services for lawful purposes only.
Account Responsibilities
  • You must provide accurate and up-to-date account details.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are liable for all activity conducted through your account.
  • You must notify us immediately if you believe your account has been compromised.
Acceptable Use

You agree not to use our Services to:

  • Host or distribute malware, spam, phishing content, or abusive material.
  • Infringe the intellectual property rights of others.

Payment and Billing
  • All fees are payable in Australian dollars (AUD) unless otherwise stated.
  • Payments are due in advance on the billing cycle selected (monthly, yearly, etc.).
  • Invoices not paid by the due date may result in suspension or termination of Services.
  • Domain registration and SSL certificate fees are non-refundable.
Service Availability and Support
  • We strive to maintain 99.9% uptime across our network.
  • Scheduled maintenance may result in temporary downtime, and we will provide notice where possible.
  • Support is available via email, phone, or ticket system during published support hours.
Backups and Data
  • We perform regular server backups for disaster recovery.
  • Backups are not guaranteed, and customers are responsible for maintaining their own website and data backups.
  • We are not liable for data loss, corruption, or unauthorised access beyond what is required under the ACL.
Liability and Warranties
  • To the maximum extent permitted by law, HostFire excludes all warranties except those required by the Australian Consumer Law (ACL).
  • Our liability for failure to comply with consumer guarantees is limited (at our discretion) to:
    1. Supplying the Services again, or
    2. Paying the cost of having the Services supplied again.
  • We are not liable for loss of profits, revenue, business, or data arising from your use of our Services.
Suspension and Termination

We may suspend or terminate your account if:

  • You breach these Terms or our Acceptable Use Policy.
  • You fail to pay fees by the due date.
  • We are required by law or regulatory authority.

You may cancel your account at any time by providing written notice. Prepaid fees are non-refundable except as required by law.

Domains and SSL Certificates

You agree not to use our Services to:

  • Domain names are subject to the rules and policies of the relevant domain registry (e.g., .auDA for .au domain)
  • SSL certificates are issued and governed by third-party certificate authorities.
  • We are not responsible for loss, suspension, or cancellation of domains or SSL certificates caused by your failure to comply with registry/issuer requirements.
Privacy

Your personal information will be handled in accordance with our Privacy Policy. By using our Services, you consent to such collection and use.

Changes to Terms

We may update these Terms from time to time. Updates will be posted on our website, and your continued use of our Services constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
